Marchington Charity 

 

John Marchington who died in Nov 1630. Left a charitable fund in his Will dated 20 Nov 1630.
There was a dispute over the title deed of this property in relation to the ground rent which was charged at 20 shillings per year.


John Marchington left 20 shillings yearly to be paid to the Person of the church wardens of Chapel en le Frith on Friday three weeks after Ascension-day  for ever for towards the maintenance, education & schooling of five poor children of Chapel en le Frith. The said 20's yearly to be issuing forth of the messuage or burgage (house) in Chapel en le Frith. The messuage charged with this payment appears from the title-deeds relating thereto to have been formally called Bradley House. It is situated near the entrance to the Church Yard on the south west corner & is now the property of George Chapel, having been divided into two tenements.

The rent charged of 20's has been paid to the master, who taught the school noticed under the proceeding head, until 1818 when George Chapel first became interested in the premises on his marriage with Clarissa Ibberson, who had purchased them in 1809.

The rent charged has since been demanded of him but he has refused to pay it on the grounds that in the deed of sale to Clarissa Ibberson the premises were charged free of in-cumbrance (ground rent).

upon inspecting the title deed it appears that the charge is not noticed in the deed of sale of 1809, but in all the previous deeds it is expressly mentioned, and from 1809 to 1818 the payment was regularly made by the tenant & allowed to him by his landlord as a deduction from his rent. Under these circumstances we apprehend that George Chapel  cannot insist on behalf of his wife  that she had no notice of the charge supposing that would be a good defense, and that as there is no doubt as to the identity of the premises, he is liable to make good the arrears now due, and to pay the rentcharge in future.
Until payment was withheld some children were taught free in respect thereof, but the number did not amount to five.

Letter written to the Rev' Grundy of Chapel dated 20 Nov 1828

Receive £10 for ten years arrears. £ 3. 12s. was paid to the Attorney General  which was deducted from the £10 which leaves £6. 81s. available for the purpose of the charity.
The sum of £6. 81s. is invested in a savings bank in Bakewell, bearing the date 26 Jan 1829.
